HON'BLE SRI JUSTICE T. VINOD KUMAR CRIMINAL PETITION NO.2336 OF 2020 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.4359 of 2019 on the file of the learned XII Metropolitan Magistrate, Ranga Reddy District at Kukatpally, wherein the petitioner herein is arrayed as accused and charged for offences under Section 323, 506 IPC. 2.

The criminal petition is taken up for hearing today, i.e. 02.06.2020, through Video Conferencing.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner after making submission on merits of the matter to substantiate quashing of the proceedings pending before the XII Metropolitan Magistrate, Kukatpally, the matter for sometime, learned counsel for the petitioner submits that the relief in the present criminal petition can be restricted to granting dispensation of the presence of petitioner / Accused before the trial court in the CC No. 4359 of 2020 on every date of adjournment.

Having regard to the submissions made as above, and considering the fact and circumstances of the case, this Court is of the view that the presence of the petitioner can be dispensed with before the court below. Accordingly, the personal appearance of the petitioner, who is the sole accused in C.C.No.4359 of 2019, pending on the file of the XII Metropolitan Magistrate, Ranga Reddy at Kukatpally, is hereby dispensed with for the present, while

permitting to mark the appearance through his counsel. The petitioner shall appear in person as and when his presence is required by the trial Court in connection with trial of C.C.No.4359 of 2019.

Subject to the above observation, the criminal petition is disposed of.
