HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16191 of 2016 ORDER:

Vide present Criminal Petition, the petitioner seeks a direction thereby directing the Station House Officer, Police Station, Charminar, Hyderabad to enlarge him on bail in the event of his arrest in connection with Crime No. 210 of 2016 registered for the offences punishable under Sections 406 and 420 IPC. Learned Additional Public Prosecutor appearing on behalf of the respondent-State informed this Court that earlier the petitioner has filed Writ Petition No.38385 of 2016 seeking the very same relief and the same is pending adjudication. However, the petitioner has not disclosed the said fact and filed the present petition concealing the same.

Learned Counsel appearing on behalf of the petitioner/Accused submits that he has not filed the said Writ Petition and therefore he is not aware of the said Writ Petition. Keeping in view the fact that the petitioner has filed the aforesaid Writ Petition seeking the very same relief, wherein the Writ Court has declined to grant stay of arrest while ordering notice. However, concealing the said fact, the present petition is filed by the petitioner when he could not get the relief from the Writ Court.

In view of the foregoing discussion, I am not inclined to grant bail. Accordingly the Criminal Petition is dismissed.
