The alleged inaction on the part of the respondent police in proceeding with the investigation in F.I.R.Nos.204 of 2017 and 323 of 2017 is under challenge in the present writ petition. 2.

According to the written instructions, dated 1.3.2018, furnished by the Sub-Inspector of Police, Suryapet Town Police Station, Suryapet District, which are placed on record by the learned Government Pleader for Home, in respect of Crime No.204 of 2017, registered on the complaint of the petitioner herein, the police investigated into the said crime and obtained permission from the Sub-Divisional Police Officer, Suryapet Division to refer the complaint of the petitioner as civil in nature. It is further stated in the written instructions that since the petitioner/complainant is evading to receive the notice, the respondent police sent the notice to the complainant by way of registered post and a final report under Section 173 Cr.P.C. will be filed before the concerned Court at the earliest.

It is further stated in the written instructions that in respect of Crime No.323 of 2017, after registration of the said crime, during the course of investigation, the Investigation Officer examined the complainant/petitioner and other witnesses and recorded their detailed statements. It is further stated that the investigation is at the initial stage and it is pending for want of examination of some more witnesses and for collection of material witnesses to establish the offences against the accused.

instructions that the Station House Officer assures this Court that the investigation would be completed as expeditiously as possible and appropriate action will be taken.

The above instructions are placed on record.

Accordingly, the Writ Petition stands disposed of, directing the respondent police authorities to complete the investigation in Crime No.323 of 2017 as expeditiously as possible. It is also made clear that if any final report is filed, it is open for the petitioner herein to avail the remedies open under law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
