ORDER :
Petitioner is a Conductor. On the allegation that petitioner was habituated to leave the Bus assigned to him and board the Bus elsewhere, he was placed under suspension. Particular instance noted in the order of suspension was that on 08.02.2017, he left the bus at 1255 hours in Golla Appara Rao Centre and boarded the bus at Agricultural Office, Tuni at 1345 hours. It is alleged that petitioner did not obtain prior permission. The disciplinary authority also noted that petitioner habituated in indulging in such things, without prior intimation or permission and by his conduct, respondent-Corporation is put to financial loss and hardship.

Learned counsel for petitioner sought to contend that what is alleged against the employee is vindictive and that there is no truth in the allegation that petitioner is habituated in resorting to such things.

These are matters, which require consideration before the disciplinary authority. It is open to the petitioner to place all the material in support of his claim to prove that what is alleged is not true.

The order of suspension would disclose that disciplinary authority has carefully considered the issue and having noted that prima facie, petitioner committed misconduct, initiated disciplinary action and placed him under suspension. It is not in dispute that the Depot Manager is the disciplinary authority and competent to
place the petitioner under suspension. Thus, I do not see any error in the decision arrived at by the disciplinary authority. Writ petition is dismissed.
