Abdullah , Sultanbin Ali v. The State Of Telangana
SMT. JUSTI CE T.RAJANI CRI MI NAL PETI TI ON No. 2 1 7 3 OF 2 0 1 8 ORDER:
This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973, seeking for grant of anticipatory bail to the petitioner-accused No. 1 in crime No. 28 of 2018 of Asifnagar Police Station, Hyderabad City.
2.
Heard learned counsel for the petitioner and learned Public Prosecutor (T.S.).
3.
The case of the prosecution is that the petitioner telephoned to the de facto complainant and demanded a ransom. Learned Public Prosecutor submits that there are other cases pending against the petitioner. Hence, in the light of the above, this Court is not inclined to consider the contention of learned counsel for the petitioner, that no report was filed with regard to the incident that took place in the month of December, 2017.
4.
Hence, considering the above, this Court opines that it is not a fit case for grant of anticipatory bail. However, the police concerned are directed to issue Section 41-A Cr.P.C. notice before effecting the arrest of the petitioner. 5.
Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
