THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.3372 of 2011 ORDER:
This civil revision petition under Section 115 of the Code of Civil Procedure, 1908 ('the Code', for short) is directed against the order dated 17.06.2011 of the learned Additional Senior Civil Judge, Eluru passed in EP.no.70 of 2008 in OS.no.110 of 2000 whereby the petition filed by the Decree Holder/1st respondent herein under Order XXI Rule 37 and Section 55 of the Code was ordered after over ruling the objections of the revision petitioner/JDr.no.2.
2. This Court, while ordering notice before admission on 18.08.2011 had granted interim stay on condition of the petitioner depositing 50% of the decretal amount within a period of six (06) weeks from that day. It is also stated in the said order that failing such deposit, the stay order shall stand vacated. Since the petitioner had not complied with the said orders, the stay orders stood vacated. The note of the Registry on a perusal would show that the EP itself was closed on 08.11.2011. The said fact is not disputed by either of the counsel. Therefore, no cause survives for adjudication in this revision.
3. Accordingly, the Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this revision shall stand closed.
