HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43176 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking to declare the inaction of the 4th respondent in issuing pattadar pass books and title deeds in favour of the petitioners, as illegal and arbitrary. Heard the learned counsel for the petitioners and the learned Additional Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.

Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the respondents for issuance of pattadar pass books and title deeds in favour of the petitioners. Learned AGP would submit that since the petitioners have not submitted the application in prescribed proforma, the question of considering their request for issuance of pattadar pass books and title deeds does not arise.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the petitioners to make application in Form-VIA seeking issuance of pattadar passbooks and title deeds in respect of lands in survey Nos.1083/2, 1084/1, 1085/3, 1085/4, 1086/3, 1086/4, 1086/5, 1087/4, 1088/2, 1088/3 admeasuring Ac.1.50 cents each situated at Peddapalli Gram Panchayat, Sidhout Mandal, YSR Kadapa District, within a period

of two weeks from today, in which event necessary orders be passed, after hearing the petitioners and other aggrieved persons, if any, in accordance with law as early as possible, preferably within a period of eight weeks from the date of making of such application.

Miscellaneous petitions pending in this petition, if any, shall stand closed. There shall be no order as to costs. ________________________ C. PRAVEEN KUMAR, J Date: 14.12.2016 sur
