THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.2714 OF 2015 ORDER:

This revision is filed under Section 115 of Civil Procedure Code (for short "C.P.C.") to revise the publication dated 29.05.2015 (proclamation of sale passed in E.P.No.24 of 2009 in O.S.No.475 of 2007 on the file of III Additional Chief Judge, City Civil Court, Hyderabad) by raising several contentions.

Present revision is filed on 14.07.2015. Learned counsel for the respondent produced a copy of memo dated 20.07.2015 filed before the III Additional Chief Judge, City Civil Court, Hyderabad i.e. 6 days after filing the present revision, informing that an amount of Rs.13,25,000/- was paid by way of Demand Drafts dated 30.06.2015, 14.07.2015 and 20.07.2015 and requested to close the above E.P.

The said memo was recorded by the Executing Court and closed the E.P.No.24 of 2009. Hence, the cause in this revision does not survive any further for adjudication and became infructuous.

Therefore, in view of closure of E.P.No.24 of 2009 in O.S.No.475 of 2007 on the file of III Additional Chief Judge, City Civil Court, Hyderabad, the revision is dismissed as infructuous. No order as to costs.

The miscellaneous petitions pending, if any, shall also stand closed.
