THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 29402 of 2013 O R D E R:

The petitioner prays for mandamus declaring the action of Respondents in not allotting a seat in ECE in 4th Respondent college for the academic year 2013-14 as illegal and unconstitutional.

On 11.10.2013 this Court granted the following interim order:

" ... If any seat in the 1st year B.Tech., (EE or Mechanical Engineering) is available in the 4th Respondent - Mahathma Gandhi Institute of Technology, Gandipet, Ranga Reddy district, the case of the petitioner may be considered against one such seat. ..."

In view of the above interim order, this Court is of the view that if the petitioner was considered and admitted, cause in the writ petition does not survive. In the alternative, if the seat was not available or for any reason the case of the petitioner could not be considered for admission in ECE for the academic year 2013-14, with the passage of time, the alternative prayer cannot and could not be considered.

Having regard to these circumstances, I am satisfied the writ petition can be disposed of by making the interim order as final order.

The writ petition is disposed of accordingly, making the interim order as final order. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
