HON'BLE SRI JUSTICE S.V.BHATT C.C. No.143 OF 2017 ORDER:

The petitioner filed the instant contempt case complaining wilful disobedience of order dated 10.11.2016 in W.P.No.38823 of 2016 by the sole respondent.

On 03.02.2017, at request of learned Government Pleader, the contempt case has been adjourned to date to file counter affidavit.

The respondent filed counter affidavit and explained the circumstances under which the appeal could not be disposed of as directed by this Court. Further on 06.01.2017, the order disposing of the appeal is also passed.

By accepting reasons stated in the counter affidavit, the contempt case can be closed. The closure of contempt case shall not be understood as this Court expressing any view on the legality of order dated 06.01.2017. The petitioner is free to work out the remedies available against such communication. With the above observation, the contempt case is closed. No order as to costs.
