Heard learned counsel for petitioner and learned Government Pleader for Services-I for respondents.

Challenging the proceedings of the 3rd respondent dated 19.02.2011 in removing the petitioner from service, the present writ petition is filed.

The petitioner was appointed as Home Guard in the year 2010 and attached to DSP Enforcement Cell of HMDA, Hyderabad at Tarnaka. Petitioner states that due to his ill-health, he could not attend his duties and after recovery, when he approached the authorities, the 3rd respondent passed the removal order without conducting any enquiry and without giving any opportunity to him. 4.

Learned counsel for petitioner submits that this Court, in identical circumstances, disposed of Writ Petition No.173 of 2017 dated 21.06.2017 and a copy of the same is placed on record. 5.

In the circumstances, following the order dated 21.06.2017 in W.P.No.173 of 2017 and for the reasons recorded therein, this Writ Petition is also allowed setting aside the order impugned. However, this order will not preclude the competent authority from taking action against the petitioner in accordance with law. The petitioner is not entitled to claim wages for the period for which he was out of
