Heard learned counsel for petitioners and learned Special Government Pleader.

When the matter is taken up, learned Special Government Pleader raised objection that 2nd respondent is not the authority concerned to take decision on the complaint filed by petitioners and only the revenue authorities are necessary parties. As the 2nd respondent is no way concerned, he could not have been arrayed as a respondent and the prayer sought in the writ petition is also not maintainable.

Having regard to this objection learned counsel for petitioners seeks to withdraw the writ petition with liberty to file fresh writ petition with better pleadings.

Liberty as sought is granted and the Writ Petition is dismissed as withdrawn. Pending miscellaneous petitions, if any, shall stand closed.
