HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION Nos.6106 & 6115 of 2018 COMMON ORDER:
Heard learned counsel for the respective petitioners, learned Government Pleader for Forests for respondents and perused the respective prayers in the writ petitions with the supporting affidavits and the impugned show cause notices respectively and orders passed in W.P.No.36748 of 2017 dated 02.11.2017 and W.P.Nos.972 & 1030 of 2018 dated 16.02.2018.
The very show cause notices respectively dated 20.10.2017 speak of the 2 saw mills are running without valid licence as can be seen from the inspection respectively dated 04/06-10.2017. It is the submission that applications are made for renewal and the applications even properly submitted with challan not accepting by the authorities. In fact there is no basis for such say for nothing prevented even by registered post by paying the requisite fees to process the application to the State level committee to consider if at all forwarded through the District Forest Officer (DFO) in turn to forward if properly filed to the Chairman i.e., Principal Chief Conservator of Forests of State Level Committee for consideration by State Level Committee.
Having regard to the above, there is nothing to keep the writ petition pending, but for enable the respective petitioners to submit the applications for renewal with challan addressing to DFO, Suryapet and Jangaon respectively, who shall entertain the applications if duly filed to forward the same to the SLC for their considering the same and taking a decision, preferably in the next sitting of the Committee.
Dr. SSRB,J With the above observations, both the Writ Petitions are disposed of.
Consequently, miscellaneous petitions, if any shall stand closed. No costs.
