Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
Aggrieved by the order of resumption passed by the Tahsildar, Ibrahimpatnam Mandal, Ranga Reddy District, the 4th respondent, dated 08.12.2015, the petitioner has filed an appeal before the Revenue Divisional Officer, East Division, Ranga Reddy District, the 3rd respondent, along with the stay petition on 02.01.2016. While the 3rd respondent is yet to fix a date for hearing of the appeal and the stay petition, the petitioner filed the present Writ Petition on the allegation that in spite of pendency of the appeal, the 4th respondent is taking steps to resume the subject land and is also stated to have come to the land of the petitioner on 04.01.2016 proposing to take possession of the same. It is evident from the record that the petitioner's appeal along with the stay petition is dated 02.01.
2016, and the same is pending with the 3rd respondent. Hence, keeping in view the threat of dispossession of the petitioner, it is appropriate to direct the 3rd respondent to fix an early date for hearing of the appeal or the stay petition and pass appropriate orders atleast to the extent of the stay petition, as expeditiously as possible and in any case within a period of two weeks from the date of receipt of a copy of this order. In order to protect the petitioner from dispossession, the impugned order of the 4th respondent shall remain stayed pending passing of the appropriate order by the 3rd respondent, as directed above.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
