HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6172 of 2018 Order:

This Writ Petition is filed for the following relief. "To issue any Writ, order or direction particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 and 2 in entertaining the documents presented/to be presented by the respondents 4 to 9, concerning the property comprises Ac.0.90 cents in Survey Nos.340/B and 341/B and Ac.0.25 cents of land in Survey No.339/B and Ac.3.20 cents in Survey No.341/B of Markapuram, Prakasam District, as arbitrary, illegal and contrary to the injunction orders against the respondents 4 to 9 in I.a.No.1855 of 2017 in O.s.No.331 of 2017 and I.A.No.1858 of 2017 in OS No.332 of 2017 on the file of the Principal Junior Civil judge, Markapuram and the decree in OS No.80 of 2006 on the file of the Subordinate Judge Court, Markapuram and consequently restrain the respondents 1 and 2 in entertaining and releasing the documents concerning the above property."

Since the learned counsel for the petitioners submits that an order of injunction is prevailing as on today, this Court is not inclined to entertain the present Writ Petition and it is open to the petitioners to bring it to the notice of the concerned Sub-Registrar seeking appropriate relief in the light of the interim order granted by the competent Civil Court. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
