THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.19776 of 2009 ORDER :

This writ petition is filed seeking to issue a writ of Mandamus to declare the notice of the 4th respondent dated 10-09-2009 as illegal and arbitrary and consequently set aside the same.

The 4th respondent - Village Secretary issued the notice dated 10-09-2009 directing the petitioner to stop the construction work undertaken by her, as the construction permission was obtained against the rules and regulations of the Grampanchayat and also in view of the objections raised by the Mandal Extension Officer and the District Panchayat Officer.

When the matter is taken up for hearing, the learned counsel on either side represented that now the 3rd respondent - Paidipalli Grampanchayat is merged into Warangal Municipal Corporation.

4. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the Warangal Municipal Corporation to issue notice to the

petitioner, if it is aggrieved by the act of the petitioner and on such notice, the petitioner is at liberty to place her explanation to the authority concerned. No order as to costs. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition are closed.
