THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5994 of 2018 ORDER:

This Writ Petition is filed challenging the notice issued under Section 7 of the Andhra Pradesh Land Encroachment Act on 29.06.2017.

The petitioner alleges that the notice was issued against the house site, which is situated in Survey No.7 of Venkatapuram Village and Mandal, Jayashankar Bhupalapalli District. The petitioner states that he submitted his objections on 10.07.2017 raising various contentions, including the ground of jurisdiction of the first respondent to take up the proceedings under the Andhra Pradesh Land Encroachment Act.

Learned Counsel for the petitioner submits that no final order has been passed as of now and, in any event, no order was communicated to the petitioner. He further submits that construction material is dumped in the nearby place and without communicating any copy of the order, steps are being taken to interfere with the subject land.

In view of the above assertions, the first respondent is directed to communicate a copy of the order, if an order was already passed, and if no order was passed, he is directed to pass appropriate orders by taking into consideration the various contentions raised in the objection petition filed by the

petitioner in order to enable the petitioner to take appropriate steps in accordance with law.

Till the order is communicated/passed, the respondents shall not interfere with the private house site of the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 23.02.2018 Note: Issue C.C by 26.02.2018.
