Kranthikumar Enuganti And 5 Others v. The State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2199 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1, A2, A3, A5, A6 and A9, in Crime No.224 of 2017 on the file of Kazipet Police Station, Warangal District. The offences alleged are under Sections 143, 307 r/w 149 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The counsel for the petitioners does not press the petition, so far as A6 is concerned, on the ground that he is arrested. He relies on the order of this Court in Crl.P.No.7202 of 2017, wherein this Court granted anticipatory bail to A4. But the order shows that, considering that he is a handicapped person, the court did not believe the probability of the petitioner attacking the injured. But, the facts of the case would show that, there is a confession made by A1, wherein, he mentioned the names of all the accused as attacking the complainant.

Hence, in the light of the above, the contention that there is a report given by A6 against the injured in this case, earlier to this complaint cannot be appreciated.

Hence, in view of above facts, this court opines that this is a not a fit case for granting anticipatory bail. 6.
Accordingly, the Criminal Petition is dismissed. However, the petitioners can file a petition seeking for regular bail by surrendering themselves before the court below having the
jurisdiction. The court below shall dispose of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
