THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.13332 OF 2017 ORDER:

Petitioner retired from service while working as Assistant Registrar on 30.04.2011. In C.C.No.157 of 2010, the petitioner was convicted under Section 248(2) of the Code of Criminal Procedure for the offence punishable under Section 409 of the Indian Penal Code and he was sentenced to undergo simple imprisonment for a period of one year and also to pay fine amount of Rs.2,000/-. Challenging the said conviction and sentence, the petitioner preferred Criminal Appeal No.153 of 2013 on the file of the Court of the VII Additional Sessions Judge, Ongole. By judgment dated 27.10.2015, the petitioner was acquitted. On retirement, the petitioner was granted provisional pension. By relying on the acquittal judgment passed by the appellate Court, the petitioner gave representation on 17.11.2016 to grant him full pension. Alleging inaction on the part of the respondents, he filed the present Writ Petition.

Since the petitioner claims that no orders are passed on his representation dated 17.11.2016, this Writ Petition is disposed of directing the respondents to pass appropriate orders on the representation submitted by the petitioner dated 17.11.2016, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
