THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2594 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners-A.1 to A.4 under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C. No.164 of 2016 pending on the file of II Additional Judicial First Class Magistrate at Kadapa for the offences under Section 498-A and 506 IPC and Sections 3 & 4 of Dowry Prohibition Act. After arguing for some time, when this Court is not inclined to quash the impugned proceedings at this stage, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioners before the trial Court. Since the offence is arising under the provisions under Section 498-A IPC, the question of identity of the petitioners before the trial Court does not arise.

In the circumstances, the presence of the petitioners before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. The petitioners are directed to be represented by a counsel on all hearing dates.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
