HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15731 of 2017 ORDER:

The Writ Petition is filed declaring the inaction of respondent Nos.1 to 3, in taking action on the petitioner's complaint dated 17.04.2017, for removal of encroachment on public road by respondent No. 4, as being illegal and arbitrary.

Petitioner claims to be the neighbour of respondent No.4. He states that the sub road admeasuring 20 feet was encroached upon by respondent No.4 raising boundary wall disabling four-wheeler to cross thereby. Hence the writ petition.

Learned counsel for the petitioner submits that the encroachment made by respondent No.4 on the public road is causing much inconvenience to the residents of the locality and, in case of emergency, ambulance also cannot cross thereby.

Sri Pasham Krishna Reddy, learned Standing Counsel for respondent Nos.2 and 3, would submit that complaint dated 17.04.2017 would be considered and necessary action would be taken for removal of encroachments on the public road at the earliest.

I consider it appropriate, therefore, to dispose of the Writ Petition directing respondent Nos.2 and 3 to consider

the petitioner's complaint dated 17.04.2017, and take necessary action for removal of encroachments in accordance with law.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
