HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.2837 OF 2021 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is liled by the petitioner/A- i, for grant of anticipatory bail in Crime No.29 ot 2O2l of P.S. Dandeppalli, Mancherial District, which was registered for the offences punishable under Sections 447 and 324 read with Section 34 ofthe Indian Penal Code.
Heard the learned counsel for the petitioner/A-1, the learned Additional Public Prosecutor representing the respondent-State and perused the record.
The allegation against the petitioner/A-1 is that the de facto complainant lodged a complaint stating that on 04.O2.2021 around 16.00 hours, while the de facto complainant was filling mud in his land with the tractor, the petitioner/A- 1 along with A-2 and A-3 went there and beat him with sticks and iron rods for which he sustained head injury and cut injury on the ear. Learned counsel for the petitioner/A- 1 would submit that the petitioner is an innocent person and never committed any offence as alleged by the respondent-police. It is further submitted that the petitioner is a law-abiding citizen and has nothing to do with the alleged offence. Further, he is ready to give sufficient I sureties to the satisfaction of this Court to secure his presence on each and every date of hearing to face the trial and also ready to abide by the terms and conditions if any that may be imposed by this Court for his release. Hence, he prayed to grant anticipatory bail to the petitioner/A- 1 .

Having regard to the facts and circumstances of the case and as it is admitted by the complainant himself in his complaint that there are civil disputes pending between the parties and as the complainant himself went to the hospital, this Court is inclined to grant anticipatory bail to the petitioner/A- 1 on some conditions. Accordingly, the Criminal Petition is allowed and the petitioner/A- 1 is directed to surrender trefore the Station House Officer, P.S. Dandepalli, Mancherial District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A- 1 on bail, on his executing personal bond for a sum of Rs.25,OOO/- (Rupees twenty five thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/A-1 shall abide by the conditions stipulated in Section a38(2) Cr.P.C and co-operate with the investigating officer in investigating the case. Miscellaneous applications, if any, pending shall stand I closed.
