THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CONTEMPT CASE No.493 OF 2019 ORDER:

This Contempt Case is filed alleging violation of the orders passed by this Court in W.P.No.14228 of 2007 dated 27.09.2018.

Counter affidavit is filed by the 2nd respondent stating that the 2nd respondent is not the competent authority to adjudicate the appeal and hence there is no willful disobedience of the orders passed by this Court in W.P.No.14228 of 2007 dated 27.09.2018.

In view of the above submission, this Court is of the considered view that since the 2nd respondent is not the competent authority to entertain the appeal, there is no willful disobedience of the orders passed by this Court in W.P.No.14228 of 2007 dated 27.09.2018.

With the above observation, the Contempt Case is closed. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
