HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7202 of 2017 ORDER:

Heard learned counsel for the petitioner/ A4 of Crime No.224 of 2017 of Kazipet Police Station, Warangal Commissionerate, registered for the offences punishable under Sections 143, 307 r/ w 149 I.P.C. from the report dated 13.07.2017 of the alleged attack on the previous day night at 9.00 p.m. on the husband of the de facto complainant, by about seven persons including the petitioner/ A4 herein and his son and also heard learned Public Prosecutor representing the State and perused the 80% Physically Handicapped Certificate of the petitioner issued by the District Medical Board, Warangal in August, 2004 and the photo showing and substantiating the same.

Though it is the contention of the learned counsel for the petitioner that the petitioner was not present at the time of occurrence and implicated falsely along with his family members involved, though he cannot move freely without sticks supporting both inner shoulder joints and the question of his attack does not arise. It is premature for this Court to entertain the Criminal Petition, much less, to interdict the investigation, but for, to say, the petitioner cannot be arrested pending investigation and if at all his presence is required, he can be called upon to appear and be interrogated if at all for the purpose of investigation.
