This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the impugned proceedings No.C/ 3254/ 2018, dated 31.01.2019, issued by the 4th respondent under sub-section (1) of Section of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1997, in so far as the land belongs to the petitioner in Survey No.100 of Kuntloor Village, Abdullapurmet Mandal, Ranga Reddy District, as arbitrary and illegal and consequently, direct the 4th respondent not to evict the petitioner from the land to an extent of Ac.3.14 guntas situated in the aforesaid survey number pending disposal of the appeal before the 3rd respondent. 2.

Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Revenue appearing for the respondents and perused the record.

Learned counsel for the petitioner would submit that the petitioner has filed an appeal before the 3rd respondent-Revenue Divisional Officer Ibrahimpatnam Division, Turkemzal, Ranga Reddy District, wherein he has also filed an application to suspend the order passed by the 4th respondent-Tahsildar, Abdullapurmet Mandal, Ranga Reddy District, vide proceedings, dated 31.01.2019. In spite of lapse of two months, the said application is not being disposed of.

There is no dispute with regard to the petitioner preferring an appeal. There is also no dispute with regard to filing of application to suspend the impugned order, dated 31.01.2019. When the matter is sub-judice before the 3rd respondent, it is not appropriate to pass any order and only a direction can be given to the 3rd respondent to dispose of the Interlocutory Application seeking to suspend the proceedings No.C/ 3254/ 2018, dated 31.01.2019.

With the above direction, the Writ Petition is disposed of directing the 3rd respondent-Revenue Divisional Officer, Turkemzal, Ranga Reddy District, to dispose of the Interlocutory Application within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
