Pulletikurthy Satyanarayanamma v. The Tahsildar, (M.R.O.)

HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.20369 of 2010 ORDER:

This Writ Petition is filed by the petitioner challenging the action of the respondents in not issuing pattadar pass book and title deed to the petitioner in spite of her applications dt.01-11-1999 and 20-08-2007 in respect of the subject land.

In the counter affidavit filed by 1st respondent, it is stated that the petitioner has no title to the land and that 7th respondent has title to the land and that was the reason why the petitioner was not issued pattadar pass book and 7th respondent was issued pattadar pass book and title deed on 30-06-1995.

When the petitioner made applications on 01-11-1999 and 20-08-2007, nothing prevented 7th respondent from informing this fact to the petitioner in writing so that the petitioner could avail appropriate remedy under the AP Rights in Land and Pattadar Pass Books Act, 1971.

Unfortunately the petitioner has been forced to file Writ Petition in 2010 by incurring considerable expenditure and wait till today to know why her application for issuance of pattadar pass book and title deed is not considered by 1st respondent. 5.

In view of the inaction on the part of the 1st respondent in disposing of petitioner's application for pattadar pass book, the petitioner has been forced to wait for almost 17 years to know why the

MSRJ W.P.No.20369 of 2010 1st respondent is not considering petitioner's application for issuance of pattadar pass book and title deed. Since it is stated that the petitioner has already availed civil remedy against 7th respondent in A.S.No.73 of 2016 on the file of II Additional District Court, Amalapuaram, if the petitioner succeeds in the said appeal or further appeals which may arise from the suit O.S.No.87 of 2007, petitioner is at liberty to approach 1st respondent for issuance of the said documents.

The Writ Petition is accordingly disposed of. However, 1st respondent shall pay costs of Rs.2,000/- (Rupees Two Thousand only) to the petitioner.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
