HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 7451 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the notification dated 18.12.2001 issued by the respondents retiring the petitioner on 30.06.2002, as illegal and arbitrary. When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner has expired. Therefore, this Court is of the view that the writ petition cannot be adjudicated on merits.

Accordingly, the writ petition is dismissed. It is needless to say that if the deceased employee is entitled for any benefits, the same will be paid to his legal representatives.
