This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.30 in Crime No.9 of 2025 on the file of PS Hyderabad Narcotics (TGANB) Hyderabad, registered for the offences punishable under Sections 8 (c) r/w. 22(c), 27A and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The facts of the case are that on 13.09.2025 at 16:00 hours, the Bowenpally Police allegedly conducted a raid at Medha School premises, where they discovered an illegal Alprazolam manufacturing unit and seized 3.302 Kgs of Alprazolam powder, 13.700 Kgs of chemical precursors, and Rs.1,21,40,000/- in cash. The investigation allegedly revealed that the contraband was supplied to toddy shop owners for illegal profits.

Heard Sri P.Vishnu Vardhan Reddy, learned counsel appearing on behalf of the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for petitioner submitted that the Petitioner has no criminal antecedents and is a law-abiding citizen with deep roots in society. He further submitted that his arrest is solely based on the confession of co-accused, which is inadmissible, and that no recovery was made from the Petitioner, and there is no live link connecting him to the manufacturing unit or the main accused. Therefore, he prayed this Court to allow the criminal petition.

On the other hand, the learned Additional Public Prosecutor, vehemently, opposed the submissions made by

learned counsel for petitioner, submitting that though no contraband was recovered from him, the financial transaction and statements of co-accused indicate his involvement in the wider network of adulteration. Therefore, he prayed this Court to dismiss the criminal petition.

Having regard to rival submissions made, and on perusing the material on record, it is noted that the petitioner was allegedly purchasing Alprazolam of 10 grams every 10 days, which constitutes an intermediary quantity. Considering the nature of allegations, the absence of recovery from the petitioner, and the period of his incarceration, this Court is of the view that the petitioner is entitled to bail, subject to compliance with the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only, with two sureties for a like sum each to the satisfaction of the Special Judicial Magistrate of First Class for Excise Cases, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier,

for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
