M/S Sri Dharni Construction, Sridi Constructions v. The Govt Of A.P And 3 Others
HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.14027 of 2010 ORDER:
The relief sought for in this Writ Petition is to declare the memo dated 12.03.2010 of the 2nd respondent, approving the tender for the work of execution of a road from Thumbakuppam Cross to Jonnagurukula Harijanawada in favour of the 4th respondent; and the consequential agreement entered into between the 3rd and 4th respondents on 05.04.2010, as illegal and arbitrary. While the Writ Petition was filed in June, 2010, no interim order was passed therein. The subject road must have been laid by now, as seven years have elapsed since the Writ Petition was filed. It is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous.
The Writ Petition is, accordingly, dismissed as infructuous. The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
