THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2238 OF 2018 ORDER:

This petition is filed by the petitioner-A7 under Section 482 Cr.P.C. to quash the proceedings in PRC No.9 of 2017 on the file of the VI Addl. Judl. Magistrate of I Class, Rajahmundry, wherein cognizance was taken for the offences punishable under Sections 285, 336 and 438 r/w 149 IPC and Motor Vehicles Act of 1989 Rule 426/190(3), 184, 132

(1) and 179 (1).

Heard the learned counsel for the petitioner, learned Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that the petitioner has nothing to do with the other accused carrying Sulphuric Acid and Hydrocholoric Acid in a private bus bearing No. AP 29 TB 5976.

Whether the petitioner is connected with the other accused can be agitated when submissions are made at the time of framing charges. The petitioner is entitled to file an application under Section 239 Cr.P.C. for discharge when there is no accusation against him to proceed with. 5.

Without expressing any opinion on the merits of the case and keeping the remedies open to the petitioner-A7 under law, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
