HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.28O9 OF 2O21 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.2 of 2027 of P.S. Tripuraram, Nalgonda District, which was registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.
Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondentState and perused the record. The allegation against the petitioner/ accused is that the de facto complainant lodged a complaint stating that the petitioner/accused promised to provide job in Municipality department and took Rs.7O,OOO/- by telling fraudulent words and later the complainant deposited Rs.2,30,0O0/- in the petitioner's account. Several times the complainant questioned the petitioner to provide job but he did not give any response and after coming to know that the petitioner cheated several other persons, the present complaint is lodged.
Learned counsel for the petitioner/ accused would submit that the petitioner is an innocent person and never committed any offence as alleged by the respondent-potice. It is further submitted that the petitioner is a law-abiding citizen and has nothing to do with the alleged offence. Further, he is ready to give sufficient sureties to the satisfaction of this Court to secure his presence on each and every date of hearing to face the trial and also ready to t
abide by the terms and conditions if any that may be imposed by this Court for his release. Hence, he prayed to grant anticipatory bail to the petitioner/ accused.
Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/ accused.
Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner/ accused on some conditions.
Accordingly, the Criminal Petition is allowed and the petitioner/ accused is directed to surrender before the Station House Officer, P.S. Tripuraram, Nalgonda District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/ accused on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitloner/ accused shall appear before the investigating authorities on every first and third Saturdays between 10.00 am and 5.00 pm till completion of investigation and filing of charge sheet and shall also abide by the conditions stipulated in Section 438(2) Cr.P.C and co-operate with the investigating officer in investigating the case. Miscellaneous applications, if any, pending shall stand closed.
