HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40524 of 2012 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in purportedly canceling the patta granted in favour of the mother of the petitioner in respect of land admeasuring Ac.4.55 cents in Sy.No.252 of Mangapathi Devipeta Village, Koyyalagudem Mandal, West Godavari District, which was devolved upon the petitioner after the death of her mother; granting pattas to respondent Nos.4 to 10 without issuing any notice to the petitioner and without conducting any enquiry as directed by this Court in W.P.No.1870 of 1986 dated 14.12.1988 and trying to dispossess the petitioner from the said land, as illegal, arbitrary and violative of principles of natural justice; and consequently direct the respondents to cancel the pattas granted in favour of respondent Nos.4 to 10.
Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that un-influenced by the pendency of the writ petition before this Court, the appellate authority may be directed to consider the case on presentation of appeal by the petitioner.
It is to be noted that it is always open to the petitioner to avail the remedies available under law and that a specific direction as sought for is not necessary in the absence of any interim order passed by this Court. Without going into the merits of the case, the present writ petition is disposed of, advising the petitioner to prefer an appeal before the appropriate authority, in which event the same shall be dealt with in accordance with law. No order as to costs.

Petition shall stand closed.
