THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5875 of 2012 ORDER:

Heard, Sri Naga Praveen Vankayalapati, learned counsel for the petitioner, learned Government Pleaders for Revenue and Panchayat Raj and Rural Development for respondents 1 and 2 and Sri G. Sheshadri, learned Standing Counsel for respondent No.3 When the matter is called, it is requested by learned counsel for the petitioner that the petitioner herein may be permitted to avail the remedy of appeal as per Section 128 of A.P. Panchayat Raj Act, 1994 by closing the writ petition and the said request is not opposed by other side. For the aforesaid reasons, the writ petition stands disposed of, permitting the petitioner to file appeal as per the provisions of Section 128 of A.P. Panchayat Raj Act, 1994, within a period of one month from the date of receipt of a copy of this order and if any such appeal is filed same be considered and appropriate orders be passed, in accordance with law, after giving notice and opportunity of being heard to all the stake-holders. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
