HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34881 of 2012 ORDER:

Heard learned counsel for the petitioner, Government Pleader for Assignment. With the consent of both the parties, the main writ petition is heard at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring Memo No.A/131/2010 dated 26.02.2010 issued by respondent No.5 as illegal, irregular, arbitrary, null and avoid and contrary to the principles of natural justice; to direct respondent Nos.1 to 4 to consider the application No.0187 made by the petitioner and to issue NOC in respect of the constructed house in land admeasuring 500 square yards in Sy.Nos.119 and 120/1, Dommara Pochampally Village, Quthubullapur Mandal, Ranga Reddy District, under the guidelines issued by the Government vide G.O.Ms.No.166 Revenue (Assignments POT) Department dated 16.06.2008; and consequently restraining the respondents from interfering with peaceful possession and enjoyment of the petitioner over the said house property.

At the time when the matter is taken up for hearing, the Government Pleader for Assignment submits that G.O.Ms.No.166 Revenue (Assignments POT) Department, dated 16.06.2008 has been withdrawn by the Government and in view of the same, fresh government orders bearing Nos.58 and 59 Revenue (Assignment-II) Department, dated 30.12.2014 were issued. Learned counsel for the petitioner submits that the petitioner herein made an application as per new government orders.

In view of the above, nothing survives for adjudication in the

present writ petition. However, the respondents shall consider the application made by the petitioner seeking regularisation of the house property as per the new government orders uninfluenced by the filing of the writ petition.

With the above direction, the writ petition is disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 18.01.2016 gkv
