THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.1977 of 2015 ORDER:

This Civil Revision Petition under Section 115 of the Code of Civil Procedure, 1908 is filed assailing the docket order dated 09.03.2015 of the learned V Additional District Judge, Kothagudem passed in A.S.No.56 of 2005.

Heard the submissions of the learned counsel for the petitioners. Perused the material record.

The learned counsel for the petitioners would submit that in the light of the statements made in the additional affidavit dated 08.06.2015 filed by the 1st petitioner along with additional material papers and in the light of the orders dated 28.06.2013 in R.C.No.A4/11/13 of the Assistant Director of Survey & Land Records, Khammam District with the annexed sketch map, nothing survives for adjudication in the civil suit and therefore, the District Collector need not adjudicate the matter in view of the orders of the Court below, which are impugned, and hence the CRP as well as the suit may be dismissed.

Without going into the merits of the matter, recording the submission of the learned counsel, the CRP is dismissed as infructuous. As a sequel, the suit shall also stand dismissed as nothing survives for adjudication.

Miscellaneous petitions, if any, pending in this revision shall stand closed.
