O R D E R
This writ petition is filed for a writ of mandamus declaring the proceedings dated 28.06.2002 issued by the 3rd respondent and confirmed by the 2nd respondent vide proceedings dated 21.01.2003 ordering recovery of an amount of Rs.6,368/-, as illegal and arbitrary. This Court while admitting the writ petition, granted interim stay of recovery of the said amount in the year 2003. Heard the learned counsel for the petitioner and Sri N.Vasudeva Reddy, learned Standing counsel for APSRTC.
Today when the matter is taken up hearing, learned counsel for the petitioner submits that the petitioner has retired from service on attaining the age of superannuation.
Since the amount impugned is meagre and petitioner already retired and stay was operating all through, I have gone through impugned proceedings and after hearing both sides, I am of the opinion that there is no justification for ordering recovery.
Accordingly, the writ petition is allowed. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 01.10.2015 dv
