THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8689 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the respondents in trying to acquire the petitioner's land admeasuring 1000 square yards out of Ac.3-21 guntas in R.S.No.342 in Bhogaram Village, Keesara Mandal, Medchal/Malkajgiri District, including structures, as arbitrary and illegal and consequently, direct the respondents to pay the compensation and initiate land acquisition proceedings as per law.

In the affidavit filed in support of the petition, it is stated that the petitioner is in possession and enjoyment of aforesaid land. Out of total extent, he constructed a house in 500 square yards and for the remaining land, he fenced with stone wiring. He also constructed a cattle shed at a length of 60 feet. On the southern side of the subject land, there is a 20 feet road existing. The respondents, in order to widen the road by 30 feet, are trying to remove the stone piller wire fencing and also trying to demolish the structures and compound wall.

Learned counsel for the petitioner submits that the respondent authorities without issuing any notice, highhandedly trying to acquire the land of the petitioner; that if the land of the petitioner is required for road widening, the respondents shall follow due process of law.

Learned Government Pleader would submit that if the land of the petitioner is required for any public purpose, the respondent authorities will follow the due process of law. 5.

Recording the submission of learned Government Pleader, the Writ Petition is disposed of directing the respondents to follow due process law if the land of the petitioner is required for any public purpose.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
