THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22616 of 2016 ORDER:

Suspension pending enquiry order dated 19.05.2016 is challenged before this Court.

Learned counsel for the petitioner fairly submits that the petitioner has already filed an appeal against the impugned order by invoking the jurisdiction of the Joint Collector (Civil Supplies), Prakasam, on 31.05.2016. He further submits that along with the appeal, the petitioner also filed an application for stay. Heard the learned counsel for the parties and perused the material available on record.

Though the learned counsel for the petitioner strenuously contends that the impugned order is only a suspension pending enquiry and therefore, the matter requires sympathetic consideration, since the petitioner has already filed an appeal against the impugned order, this writ petition cannot be entertained. In the circumstances, the writ petition is disposed of with a direction to the second respondent to pass orders on the appeal filed by the petitioner within a period of two weeks from the date of receipt of a copy of this order.
