HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6472 of 2017 ORDER:

Heard learned counsel for the petitioner/accused of C.C.No.1430 of 2015 on the file of Judicial Magistrate of First Class, Miryalaguda, where the learned Magistrate has taken cognizance for the offence under Section 138 of the Negotiable Instruments Act, outcome of private complaint of the 2nd respondent-defacto complainant and perused the grounds urged in the quash petition and the contents of the complaint. A perusal of the material on record shows there is nothing to interfere much less to quash the petition.

Having regard to the above, the Criminal Petition itself is disposed of without prejudice to all available defence of the accused. So far as the difficulty expressed by the petitioner for attending day to day to face the trial, the petitioner is given liberty to move the trial Court by filing application under Section 205 Cr.P.C. for the learned Magistrate to permit with condition to appear as and when required.
