This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed to recall the docket order, dated 01.03.2019, in Crime No.250 of 2018 of Bhadrachalam Town Police Station, passed by the Principal Sessions Judge, Khammam, whereby, Non-bailable warrant was ordered to be issued to the petitioner/ accused.

Heard the learned counsel for the petitioner/ accused and the learned Additional Public Prosecutor representing respondent No.1/ State. Perused the record.

Learned counsel for the petitioner/ accused would contend that earlier the petitioner/ accused was granted anticipatory bail by the Court of Session. Thereafter, it was cancelled by the same Court. Therefore, the impugned docket order was passed. 4.
There is a specific mention in the impugned docket order that the petitioner/ accused was called absent on the given date. As such, NBW was issued against him and the matter was posted to 06.03.2019.
In default of appearance of the petitioner/ accused before the Court below, the Court below has passed such an order. There is no impropriety or illegality in the impugned order to set aside the same. The petition is devoid of merit and is liable to be dismissed.

In the result, the Criminal Petition is dismissed.
