THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7109 of 2016

ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A9 seeking to quash the proceedings in Cr.No.126 of 2016 of Saidabad Police Station, Hyderabad City, registered for the offences punishable under Sections 354, 354(A)(2) read with Section 34 IPC, against them.

2. Heard learned counsel for the petitioners/A1 to A9 and learned Additional Public Prosecutor representing the State.

3. It is alleged in the complaint that the de facto complainant is a Christian devotional lady and is working as Sunday School Teacher in Bethel Church and that the accused, who are the members of Bethel Church, Saidabad Colony, Hyderabad, were frequently intervening into her personal life by creating annoyance and making sexual harassment to outrage her modesty and that on 03.04.2016, all the accused misbehaved with her and harassed her sexually by giving life threats.

4. As seen from the complaint, there are serious allegations against the petitioners. Truth or otherwise of the allegations made in the complaint can be ascertained by the investigating agency during the course of investigation. Therefore, this is not a fit case to quash the proceedings impugned. However, the police concerned are directed to proceed with the investigation without arresting the petitioners/A2 to A9 except the first petitioner/A1, by name K. Vidyadhara Rao. The petitioners/A2 to A9 are directed to appear before the investigating agency as and when required and

cooperate with the investigating agency.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
