HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29125 of 2015 ORDER :

Heard learned counsel for petitioner and learned Government Pleaders for respondents and with their consent, the writ petition is taken up for disposal at the admission stage.

2. This writ petition is filed declaring the action of the respondents 2 to 6 in not considering the representation of the petitioner dated 01.09.2015 for taking action against the 7th respondent in claiming false bill under non-CRF grant of Rs.5.00 lakhs without doing any work is illegal, arbitrary and unconstitutional and consequently direct the respondents 2 to 6 not to process and release any bill of payment to the 7th respondent.

3. Petitioner claims that he is a contractor and doing Government contract works and he was allotted Augmentation work to SVS at Erragunta, Dasthurabad Gram Panchayat, Kadam Mandal, Adilabad district. The grant was made under NRDWP for an estimated cost of Rs.20 lakhs. The said work was completed by constructing the water tank and pipe lines as per the grant of work and submitted the bills. The respondents 4 to 6 processed the final bill submitted by him and is pending for balance payment under final bill with the 3rd respondent. However, the Local MLA seems to have released Rs.5 lakhs worth Non-CRF grant for pipeline works. While so, petitioner came to know that 7th respondent, who is the husband of the Sarpanch of the said Gram panchayat, without doing any work got recorded his bills for Rs.

5 lakhs by showing part of completed pipe line work done by the petitioner. The petitioner further claims that he has submitted a representation through his supervisor Mr.Devender Goud, dated 01.09.2015 to the respondents 2 and 4 stating that the 7th respondent in collusion with local officials pursuing the sanction of bill by showing part of the completed work done by them and is trying to misuse the Non-CRF grant released by the Local MLA and requested the respondents to take necessary action against him.

4. When the matter is taken up, both counsels agreed for disposal of the writ petition with a direction to the 4th respondent to expeditiously dispose of the representation dated 01.09.2015 submitted by the petitioner.

5. Having regard to the same, without expressing any opinion on the merits of the matter, this writ petition is disposed of directing the 4th respondent to consider the representation of the petitioner dated 01.09.2015 and pass appropriate orders as warranted under law within a period of three weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. Miscellaneous petitions if any pending in the writ petition shall stand closed. There shall be no order as to costs.
