THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16370 of 2015 ORDER :

The petitioner herein is also the petitioner in W.P.No.16335 of 2015, sought for refund of amount paid towards building permission and the said application was filed in the year 2013. In processing the application for construction of building, permission was granted on 12.06.2013. However, on the objections raised by some

aggrieved persons, the said building application was withdrawn granting liberty to the petitioner to submit a fresh application which was submitted on 24.11.2013. In this writ petition the petitioner seeks for refund of the building application fee paid by him in the year 2013 when he applied for grant of permission for construction of building.

2. As seen from the material papers enclosed to the writ petition, no specific request is made for refund of building permission fee which he paid.

3. Having regard to the above, the Writ Petition is disposed of granting liberty to the petitioner to submit an application for refund of building permission fee paid in the year 2013 or for adjustment of the said amount towards the pending building application dated 14.11.2014. As and when such request is made, the same shall be considered by the 3rd respondent and pass appropriate orders as warranted by law. There shall be no order as to costs.
