THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2232 OF 2018 ORDER:

This petition is filed by the petitioners-A1 to A5 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.170 of 2016 on the file of the Station House Officer, Madannapet Police Station, Hyderabad District, registered for the offences punishable under Sections 304-B and 498-A IPC and 4 of Dowry Prohibition Act.

Heard the learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners would submit that the marriage of one Seetha Saritha (hereinafter referred to as 'the deceased') with the petitioner-A1 is a love marriage. Therefore, question of giving dowry does not arise. In the confession of A1, it is stated that the deceased married earlier to some other person. Thereafter, he married the deceased after the deceased taking divorce in the presence of village elders and ultimately, prayed to allow the petition. 4.

On the other hand, learned Assistant Public Prosecutor opposed the relief sought for by the petitioners in the petition.

As per the material placed on record, there are specific and grave allegations causing mental and physical cruelty to the deceased. There are also allegations against the in-laws that they were oftenly visiting the house of A1 and the deceased and subjecting the deceased to mental and physical cruelty. There are allegations of demand of additional dowry. There are number of other allegations

constituting the offences. Whether the deceased is the legally wedded wife of A1 will be looked into by the Investigating Officer in due course of investigation. There are no merits to concede the request of the petitioners. 6.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
