HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CIVIL MISCELLANEOUS PETITION No.587 OF 2017 ORDER:
Though, notice was served on the respondent-husband, and proof of service therefor is filed, none appears for the respondent. Keeping in view, the submission made by the learned counsel for the petitioner, Sri K.S. Murthy, that the distance between two courts is more than 200 kms and the petitioner has to look after girlchild by name Sahithi born out of their wedlock on 9.12.2013 and also in view of the fact that M.C. No.4 of 2016 pending on the file of Judicial Magistrate of First Class, Rampachodavaram, East Godavari District, her request can be acceded to.
Therefore, the Transfer Civil Miscellaneous Petition is allowed. F.C.O.P. No.1187 of 2016 pending on the file of Judge, Family Court at Visakhapatnam is withdrawn and transferred to the file of Judge, Family Court-cum-Additional District Judge, Rajamahendravaram, East Godavari District. The Transferee Court shall issue notices to both parties and dispose of the F.C.O.P. in accordance with law. There shall be no order as to costs.
