HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.354 OF 2017 ORDER:

This Criminal Petition is filed by the petitioner-A.2 under Section 438 of Cr.P.C. to grant pre-arrest bail to the petitioner in Crime No.149 of 2016 of Godavarikhani II Town Police Station, Peddapalli District, registered for the alleged offence punishable under Section 420 I.P.C. apprehending arrest in the above crime. Petitioner herein is A.2.

The case of the prosecution, in brief, is as follows: Petitioner-A.2 and others collected Rs.3,50,000/- from the defacto complainant by falsely promising to provide Junior Assistant Job in BC Welfare Department to the defacto complaint, therefore, the accused issued blank cheque for Rs.75,000/- to the defacto complainant but the accused persons cheated him, on that the complainant asked to return money but they did not respond. Hence, the petitioner and others allegedly committed an offence punishable under Section 420 I.P.C.

It appears from the material on record that the petitioner along with others while making promise to provide employment to the defacto complainant in B.C.Welfare Department collected huge amount from the brother of the defacto complainant. Collecting such amount and not providing the job is sufficient that the petitioner along with others cheated the public, assuring to provide employment in the various departments in the State of Andhra

MSM,J Crlp_354_2017 Pradesh and making false promise and inducing them to pay huge amount would prima facie constitute an offence punishable under Section 420 of I.P.C. as such I find prima facie material to conclude that the petitioner committed offence punishable under Section 420 of I.P.C. Hence, I find that there are no grounds to grant pre-arrest bail to the petitioner-A.2 and thereby this petition is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed. As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. __________________________________ JUSTICE M.SATYANARAYANA MURTHY Dated 30-1-2017.
