THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5392 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/A.2 and A.3, A.5 to A.8 seeking grant of anticipatory bail in connection with crime No.156 of 2014 on the file of the P.S., Razole, East Godavari District, registered for the offences under Sections 420 and 409 IPC read with Section 34 IPC and Section 5 of the A.P.Protection of Depositors of Financial Establishments Act, 1999.

Heard and perused the material.

Learned counsel for the petitioners submits that the case is registered in the month of September, 2014 and that A.1 is arrested and subsequently, released on bail.

The first petitioner herein is the wife of the first accused, who is the Director of the company. The other petitioners are private employees. Even according to the prosecution, A.1 is the main accused, who played role to collect deposits from the depositors.

Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners/ A.2 and A.3, A.5 to A.8. In the circumstances, the petitioners/ A.2 and A.3, A.5 to A.8 are directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, they shall be enlarged on bail on the same day on their executing personal bonds for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for a like sum each to the satisfaction of the said Magistrate. Further, the petitioner/A.1 is directed to report before the Station House Officer as and when required. The petitioners 2 to 6/A.3 and A.5 to A.8 are directed to report before the Station House Officer concerned, daily between 10.00 a.m., and 5.00 p.m., for a period of fifteen (15) days.
