O R D E R

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner/accused in Crime No.21 of 2026 of Ramadugu Police Station, Karimnagar District, registered for the offences punishable under Sections 108 and 351 (2) of the BNS.

Heard Sri D.Bhaskar Reddy, learned counsel for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

The case of the prosecution is that on 30.01.2016, the complainant lodged a complaint against the accused stating that the accused pressurized him to withdraw the case registered against him, otherwise he will kill the complainant and also beat him. Thereafter, also continuously he has been harassing him. On 17.01.2026 at about 15:00 hours, the deceased informed his family members that he was going outside and would return shortly and later, when his elder son contacted the deceased over phone, he informed that accused would kill their family, as such the deceased consumed some unknown pesticide near Pitttala Rayanarsu fields at the outskirts of Village. Hence, the complainant lodged a complaint requesting the police to register a case against the accused. Basing on the same, police registered a case for the aforesaid offences.

Learned counsel for the petitioner would submit that none of the allegations made the complaint would attract the offence under Section 108 of BNS; that there is no nexus between the deceased and the accused and that custodial investigation is not required in this case and hence, he prays to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed the same and contended that the offences alleged against the petitioner are severe in nature and that custodial interrogation of the petitioner is required in this case and hence, he prays to dismiss the petition.

Having regard to the submissions made by both the parties and considering the material on record, it is noted that the petitioner threatened the deceased to withdraw the case registered against him, otherwise he will kill him. However, there is delay in lodging the report. Considering the allegations made against the petitioner, this Court is inclined to grant Anticipatory bail to the petitioner subject to the following conditions:

(i) The petitioner shall surrender before the Station House Officer, Ramadugu Police Station, Karimnagar District, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each.

(ii) The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

(iii) The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
