THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.511 of 2019 ORDER:

This contempt case was instituted alleging willful disobedience to the order dated 29.08.2018 passed in W.P.No.30800 of 2018. By the said order, respondents 3 and 4 therein, viz., the Tahsildar, Doma Mandal, Vikarabad District, and the Mandal Surveyor, Doma Mandal, Vikarabad District, were directed to deal with the representations made by the petitioners on 27.11.2017 and 27.06.2018 and pass appropriate orders thereon.

It is an admitted fact that the Tahsildar, Doma Mandal, Vikarabad District, issued Memo dated 28.09.2018 after considering the applications of the petitioners and rejected their request for a survey to be undertaken. The correctness of this Memo cannot be assessed in contempt proceedings. In the event the petitioners are aggrieved by the rejection of their request, under the Memo dated 28.09.2018, they have a separate cause of action for filing an independent case afresh.
