HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.17443 of 2016 ORDER:

The facts of the present case are similar to the facts in W.P.No.17434 of 2016 which was disposed of by this Court on 29.08.2016, wherein this Court directed respondent Nos.5 and 6 to take decision on the petitioner's representation dated 10.08.2015 within a period of four weeks from that day after affording opportunity to the parties concerned.

Learned Government Pleader for Land Acquisition informed this Court that award was passed and, pursuant thereto, compensation has been disbursed in favour of the persons who participated in acquisition proceedings. However, part of the compensation amount has not yet been disbursed.

In the circumstances, Writ Petition is disposed of directing respondent Nos.5 and 6 to take decision on the petitioner's representation dated 10.08.2015 within a period of four weeks from today after affording opportunity to the parties concerned. The decision taken shall be communicated to the petitioner within one week thereafter. I further direct respondent Nos.5 and 6 not to disburse the remaining compensation amount in favour of any of the parties till the decision is taken on the petitioner's representation dated 10.08.2015.

Miscellaneous Petition pending, if any, shall also stand disposed of. No order as to costs.
